Terms of Service

Placing an order with us means agreeing to these terms. They are written to be read, not to be skipped.

Orders and acceptance

An order becomes binding when we confirm it and payment is received. We may decline an order — before or after payment, with a full refund — if the item is out of stock, if the artwork falls foul of the content rules below, if the delivery address is not serviceable, or if we believe the order is fraudulent.

For custom work, the mockup you approve is the specification. What we produce is matched against that approved mockup, so please review it properly before confirming.

Pricing and payment

All prices are in Indian Rupees and are inclusive of GST unless the invoice says otherwise. Orders are prepaid; production does not start until payment or the agreed advance has cleared. Bulk orders typically run on an advance against the quote with the balance due before dispatch.

We may change prices at any time, but never on an order already confirmed. If we have made an obvious pricing error on a listing, we will contact you and either honour it or cancel and refund in full — we will not silently ship something different.

Your artwork and intellectual property

By uploading artwork or asking us to print a design, you confirm that you own the rights to it or have permission from the rights holder to have it reproduced on garments. That responsibility sits with you, because we have no way of verifying it.

You indemnify Upper Circuit against any claim, loss or legal cost arising from artwork you supplied infringing someone else's copyright, trademark, design right or personality right.

You keep ownership of your artwork. We keep ownership of our own designs, patterns, product photography and site content, which may not be reproduced without written permission.

Artwork we will not print

We reserve the right to refuse any artwork, at our sole discretion and with a full refund, including designs that infringe a third party's rights, promote hatred or violence against any group, sexualise minors, are obscene, or are unlawful under Indian law.

This is a judgement call we make and we will tell you plainly if we are making it. Refusing a design is not a comment on you; it is us deciding what leaves our floor with our machines on it.

Colour, fit and variation

Screens render colour differently, and fabric dye lots vary slightly between batches. Small variation between what you see on this site and the garment you receive is normal and is not a defect. Print placement is accurate to within roughly half an inch, which is the practical tolerance of manual placement.

Garment measurements can vary by up to half an inch against the published size chart. Anything beyond that is a defect and is covered by our returns policy.

Liability

Our liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including missed events or deadlines, except where the delay was caused by our own failure to meet a deadline we had confirmed in writing.

Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu.
